PERATURAN PEMERINTAH REPUBLIK INDONESIA PERATURAN PEMERINTAH REPUBLIK INDONESIA NOMOR 5 TAHUN 2015 TENTANG JENIS DAN TARIF ATAS JENIS PENERIMAAN NEGARA BUKAN PAJAK YANG BERLAKU PADA LEMBAGA PENYIARAN PUBLIK RADIO REPUBLIK INDONESIA DENGAN RAHMAT TUHAN YANG MAHA ESA PRESIDEN REPUBLIK INDONESIA, Menimbang : bahwa untuk melaksanakan ketentuan Pasal 2 ayat (2) dan ayat (3) serta Pasal 3 ayat (2) Undang-Undang Nomor 20 Tahun 1997 tentang Penerimaan Negara Bukan Pajak, perlu menetapkan Peraturan Pemerintah tentang Jenis dan Tarif atas Jenis Penerimaan Negara Bukan Pajak yang Berlaku pada Lembaga Penyiaran Publik Radio Republik Indonesia; Mengingat :
Pasal 5 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945;
Undang-Undang Nomor 20 Tahun 1997 tentang Penerimaan Negara Bukan Pajak (Lembaran Negara Republik Indonesia Tahun 1997 Nomor 43, Tambahan Lembaran Negara Republik Indonesia Nomor 3687);
- Peraturan Pemerintah Nomor 22 Tahun 1997 tentang Jenis dan Penyetoran Penerimaan Negara Bukan Pajak (Lembaran Negara Republik Indonesia Tahun 1997 Nomor 57, Tambahan Lembaran Negara Republik Indonesia Nomor 3694) sebagaimana telah diubah dengan Peraturan Pemerintah Nomor 52 Tahun 1998 tentang Perubahan atas Peraturan Pemerintah Nomor 22 Tahun 1997 Tentang Jenis dan Penyetoran Penerimaan Negara Bukan Pajak (Lembaran Negara Republik Indonesia Tahun 1998 Nomor 85, Tambahan Lembaran Negara Republik Indonesia Nomor 3760);

Menetapkan : PERATURAN PEMERINTAH TENTANG JENIS DAN TARIF ATAS JENIS PENERIMAAN NEGARA BUKAN PAJAK YANG BERLAKU PADA LEMBAGA PENYIARAN PUBLIK RADIO REPUBLIK INDONESIA.
Pasal 1
(1)Jenis Penerimaan Negara Bukan Pajak yang berlaku pada Lembaga Penyiaran Publik Radio Republik Indonesia meliputi penerimaan dari jasa:
siaran; dan
penggunaan sarana dan prasarana siaran.
(2)Tarif atas jenis Penerimaan Negara Bukan Pajak sebagaimana dimaksud pada ayat (1) huruf a dihitung berdasarkan formula.
(3)Jenis dan Tarif atas jenis Penerimaan Negara Bukan Pajak sebagaimana dimaksud pada ayat (1) huruf b ditetapkan dalam Lampiran Peraturan Pemerintah ini.
Pasal 2
(1)Formula sebagaimana dimaksud dalam Pasal 1 ayat (2) adalah sebagai berikut: Jasa Siaran = Air Time + Biaya Produksi (2) Tarif air time sebagaimana dimaksud pada ayat (1) ditetapkan dalam Lampiran Peraturan Pemerintah ini.
(3)Tarif biaya produksi sebagaimana dimaksud pada ayat (1) sesuai Standar Biaya yang ditetapkan oleh Menteri Keuangan.
(4)Tarif biaya produksi sebagaimana dimaksud pada ayat (1) untuk produksi yang dilaksanakan oleh Wajib Bayar, besaran biaya produksi sebesar Rp0,00 (nol rupiah).
Pasal 3
(1)Tarif air time sebagaimana dimaksud dalam Pasal 2 ayat (2) dan tarif atas jenis penerimaan negara bukan pajak berupa jasa penggunaan sarana dan prasarana siaran sebagaimana dimaksud dalam Pasal 1 ayat (3) dikelompokkan dalam:
Jaringan Nasional;
Zona A;
Zona B;
Zona C; dan/atau
Zona D.
(2)Penentuan pembagian jaringan nasional dan zona sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Direktur Utama Lembaga Penyiaran Publik Radio Republik Indonesia.
Pasal 4
(1)Tarif komponen jasa siaran berupa airtime yang terdiri atas dialog interaktif, siaran langsung, siaran tunda, dan sandiwara radio dan tarif jasa penggunaan sarana dan prasarana berupa sound system untuk penyelenggaraan siaran di luar auditorium dan/atau studio Radio Republik Indonesia sebagaimana dimaksud dalam Lampiran, tidak termasuk biaya akomodasi, konsumsi, dan transportasi.
(2)Biaya akomodasi, konsumsi, dan transportasi sebagaimana dimaksud pada ayat (1) dibebankan kepada Wajib Bayar sesuai dengan ketentuan peraturan perundang-undangan.
Pasal 5
(1)Terhadap kegiatan tertentu atas Jenis Penerimaan Negara Bukan Pajak yang berlaku pada Lembaga Penyiaran Publik Radio Republik Indonesia berupa jasa siaran sebagaimana dimaksud dalam Pasal 1 ayat (1) huruf a dapat dikenakan tarif sebesar Rp0,00 (nol rupiah).
(2)Kegiatan tertentu sebagaimana dimaksud pada ayat (1) terdiri atas:
kenegaraan;
pertahanan dan keamanan;
sosial dan budaya;
keagamaan;
bencana alam;
kemanusiaan; dan
kerjasama siaran dengan lembaga radio internasional dan duta besar negara sahabat.
(3)Ketentuan lebih lanjut mengenai persyaratan dan tata cara pengenaan tarif sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Direktur Utama Lembaga Penyiaran Publik Radio Republik Indonesia setelah mendapat persetujuan dari Menteri Keuangan.
Pasal 6
Seluruh Penerimaan Negara Bukan Pajak yang berlaku pada Lembaga Penyiaran Publik Radio Republik Indonesia wajib disetor langsung secepatnya ke Kas Negara.
Pasal 7
Peraturan Pemerintah ini mulai berlaku setelah 60 (enam puluh) hari terhitung sejak tanggal diundangkan. Agar setiap orang mengetahuinya, memerintahkan pengundangan Peraturan Pemerintah ini dengan penempatannya dalam Lembaran Negara Republik Indonesia. UMUM Untuk mengoptimalkan Penerimaan Negara Bukan Pajak guna menunjang pembangunan nasional, Penerimaan Negara Bukan Pajak pada Lembaga Penyiaran Publik Radio Republik Indonesia sebagai salah satu sumber penerimaan Negara perlu dikelola dan dimanfaatkan untuk peningkatan pelayanan kepada masyarakat. Sehubungan dengan hal tersebut dan untuk melaksanakan ketentuan Undang-Undang Nomor 20 Tahun 1997 tentang Penerimaan Negara Bukan Pajak, perlu menetapkan jenis dan tarif atas jenis Penerimaan Negara Bukan Pajak yang berlaku pada Lembaga Penyiaran Publik Radio Republik Indonesia dengan Peraturan Pemerintah. Ayat (1) Yang dimaksud dengan “Jaringan Nasional” adalah siaran yang jangkauannya meliputi seluruh wilayah Negara Kesatuan Republik Indonesia. Yang dimaksud dengan “Zona” adalah penetapan wilayah siaran tertentu atas dasar potensi ekonomi, potensi penerimaan, jumlah penduduk, daya beli masyarakat, dan sebagainya. Ayat (2) Cukup jelas.

Ayat (1) Cukup jelas. Ayat (2) huruf a Yang dimaksud dengan “kenegaraan” antara lain siaran kegiatan Presiden/Wakil Presiden sebagai Kepala Negara dan/atau Kepala Pemerintahan sesuai agenda negara dan/atau pemerintahan. huruf b Yang dimaksud dengan “pertahanan dan keamanan” adalah siaran kegiatan kesiagaan masyarakat dalam situasi dan kondisi darurat sipil dan darurat militer, siaran kegiatan negara dalam situasi dan kondisi darurat perang. huruf c Yang dimaksud dengan “sosial dan budaya” adalah siaran kegiatan berkenaan dengan sosial dan pelestarian budaya yang diprakarsai oleh masyarakat secara swadaya. huruf d Yang dimaksud dengan “keagamaan” adalah siaran kegiatan berkenaan dengan hari besar keagamaan. huruf e Yang dimaksud dengan “bencana alam” adalah siaran yang berkenaan dengan darurat bencana dan penanganan korban bencana. huruf f Yang dimaksud dengan “kemanusiaan” adalah siaran yang berkenaan dengan wafatnya tokoh Negara, berita duka/kematian dan informasi orang hilang. huruf g Yang dimaksud dengan “kerjasama siaran dengan lembaga radio internasional dan duta besar negara sahabat” adalah siaran kerja sama dengan lembaga penyiaran radio internasional dan kedutaan besar negara sahabat.
